Crush‑It Hard Iced Tea

User‑Generated Content Consent & Release

By uploading, submitting, or otherwise providing photos, videos, text, or other content (“Content”) to Radouga Distilleries Inc., Crush‑It Hard Iced Tea (“Crush‑It,” “we,” “us,” or “our”) through this website or any affiliated platform, you agree to the following:

  1. Age Confirmation

You confirm that:

  • You are of legal drinking age in your province or territory of residence (at least 19 years old in Saskatchewan);
  • No person depicted in the Content is under the legal drinking age; and
  • You are legally permitted to engage with alcohol‑related marketing content.

 

  1. Ownership and Permissions

You represent and warrant that:

  • You own all rights to the Content you submit, or you have obtained all necessary permissions, licenses, and releases from any individuals, rights‑holders, or property owners appearing in the Content;
  • The Content does not infringe or violate any third‑party rights, including copyright, trademark, privacy, publicity, or moral rights; and
  • Any individuals appearing in the Content have consented to its use for the purposes described below.

To the fullest extent permitted by law, you waive any moral rights you may have in the Content in favour of Crush-It, including any rights of attribution or integrity.

 

  1. License Grant (Permission to Use Content)

You grant Crush‑It a perpetual, irrevocable, worldwide, royalty‑free, transferable, and sublicensable license to use your Content for any lawful business and promotional purpose, including but not limited to:

  • Website and digital properties
  • Social media channels
  • Advertising and promotional campaigns
  • Print and point‑of‑sale materials
  • Email marketing and presentations

This includes the right to reproduce, distribute, display, perform, publish, adapt, edit, modify, crop, combine, or otherwise alter the Content, with or without attribution, at our discretion.

 

  1. No Compensation

You acknowledge that:

  • You will not receive compensation, payment, royalties, or other consideration for the use of your Content; and
  • Submission of Content is voluntary.

 

  1. Waiver and Release of Liability

You agree to indemnify, defend, and hold harmless Crush‑It, its officers, directors, employees, agents, and partners from any third-party claims, demands, damages, losses, or liability arising out of or related to:

  • Our use of the Content as permitted above;
  • Any claims of infringement, misappropriation, or violation of rights relating to the Content; or
  • Your breach of the representations and warranties set out in this consent.

 

  1. Content Standards and Moderation

You acknowledge and agree that:

  • Crush‑It reserves the sole discretion to review, moderate, reject, remove, or decline to use any submitted Content at any time;
  • Content may be removed or rejected if it is deemed unlawful, offensive, misleading, inappropriate, unsafe, promotes irresponsible consumption, or otherwise inconsistent with our brand values;
  • Content must comply with all applicable alcohol advertising laws, regulations, guidelines, and self‑regulatory codes, including those of applicable provincial liquor authorities and Advertising Standards Canada;
  • Submission of Content does not constitute participation in a contest or promotional offer unless expressly stated; and
  • Submission does not guarantee publication or use.

 

  1. No Obligation to Use Content

Crush‑It is under no obligation to post, publish, or otherwise use any submitted Content.

 

  1. Privacy

Any personal information collected in connection with the submission or use of Content will be handled in accordance with our Privacy Policy and applicable Canadian privacy laws, including PIPEDA.

 

  1. Governing Law

This consent is governed by the laws of Saskatchewan and the laws of Canada applicable therein.
